You have signed a contract and paid in advance, and now you discover that your new kitchen cabinets don’t fit. Generally, the contract is definitive.
However, a decision of the court of appeals of Grenoble (15th December 2008) permitted the cancellation of such a contract and the reimbursement of the advance on the grounds that the seller did not take the measurements of the kitchen. To cancel the contract, send a claim to the professional by registered mail with proof of delivery. If he refuses reimbursement, you may take him to the “tribunal d’instance” (civil court, for claim amounts between 4000 and 10.000€) or the “grande instance” (higher court, for amounts up to 10.000€) but beware: your case depends on the individual appreciation of the judges.
